If you instruct us on a matter related to discrimination, we may collect personal data such as your racial or ethnic origin, gender and sexual orientation, and religious or similar beliefs. In some cases, we may also collect personal identifying information such as your eye colour or your parents’ names, for example, if you instruct us to incorporate a company for you.

In certain cases, we may also collect your medical records, for example, if we are acting for you in a personal injury claim. We may also collect monitoring information, such as your use of our IT, communication and other systems, and other monitoring information if you use our secure online client portal after it is set up.

How and why we use your personal data

Under data protection law, we can only use your personal data if we have a proper reason for doing so.

We use your personal data for several reasons, including complying with our legal and regulatory obligations, performing our contract with you or taking steps at your request before entering into a contract, pursuing our legitimate interests or those of a third party, or processing your data with your consent.

A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests.

We use your personal data to provide legal services to you, which is necessary for the performance of our contract with you or to take steps at your request before entering into a contract. We conduct checks to identify our clients and verify their identity, screen for financial and other sanctions or embargoes, and process other necessary information to comply with professional, legal and regulatory obligations that apply to our business.

We also gather and provide information required by or relating to audits, enquiries, or investigations by regulatory bodies, ensure business policies are adhered to, and for operational reasons, such as improving efficiency, training, and quality control. Additionally, we ensure the confidentiality of commercially sensitive information, perform statistical analysis to help us manage our practice, and prevent unauthorised access and modifications to the systems.

Updating and enhancing client records is important for the performance of our contract with you or to take steps at your request before entering into a contract. We also comply with legal and regulatory obligations and have legitimate interests or those of a third party to keep in touch with our clients about existing and new services.

We comply with our legal and regulatory obligations by submitting statutory returns and ensuring safe working practices, staff administration, and assessments. Additionally, we market our services to existing and former clients, third parties who have previously expressed an interest in our services, and third parties with whom we have had no previous dealings, which is for our legitimate interests or those of a third party.

To ensure that our clients are likely to be able to pay for our services, we conduct credit reference checks via external credit reference agencies. Finally, we conduct external audits and quality checks and audit our accounts to maintain our accreditations so we can demonstrate that we operate at the highest standards. This table does not apply to special category personal data, which we will only process with your explicit consent.

We have a legitimate interest in processing your personal data for promotional purposes (see above ‘How and why we use your personal data’). This means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly.
